The terms and conditions are only valid for the use of the website www.sofa-bargains.com.

The terms and conditions below are completely binding on you and the company once you place the order. Accessing our site or placing an order over the phone with a customer sales advisor indicates your complete agreement to these terms and conditions.

ASA Furniture Ltd uses the trading name Sofa Bargains.

 

AVAILABILITY

The products displayed on our website are available only in the United Kingdom and Ireland. Delivery and purchase can only occur in the United Kingdom or Ireland.

To all extent that is reasonably and legally possible, all products featured for sale on this site are in stock and available at the time of ordering. Any lead times may require as much as two to three weeks for some items however we will endeavour to get your products to you as soon as possible.

 

CUSTOMER ELIGIBILITY AND STATUS REQUIREMENTS

In order to be eligible to purchase products on this website you must.

-       Be 18 (eighteen) years of age or older.

-       Provide your true name and contact details including your e-mail address.

-       Be legally capable of entering into binding contracts.

-       Provide a valid delivery address in Ireland or the United Kingdom.

 

Your order establishes an offer to us to buy Goods and services linked to buying the Goods (“Order”). All Orders are subject to acceptance by us, which we are free to accept or decline at our absolute discretion. Confirmation of your Order will commence by sending you an e-mail confirming our acceptance (“Order Confirmation”) or an email. This contract will be formed when we send you our Order Confirmation or confirm via email.

We shall assign an order number to the Order and inform you of it in the Order Confirmation. Please quote the order number in all subsequent correspondence with us relating to the Order. We hold the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, technology, payment methods, relevant laws and regulatory requirements and/or in our system's capabilities. You will be subject to the policies and terms in force at the time that you order the Goods from us, unless any change to those policies or these terms is required by law or government or regulatory authority (in which case, it will apply to orders you have previously placed that we have not yet fulfilled).

 

PAYMENT

The order page of the site indicates the price of any product ordered and the price set out in the order as presented and printable in the order page of the website is the true price.

Prices are liable to change at any time. Price changes made subsequent to an order will not affect the price for the products designated in your order at the time that you placed the order. VAT is included in all prices quoted on the site.

Credit or debit card, bank transfer, PayPal and cash on delivery are acceptable forms of payment. Bank transfer details are available on request.

Credit card and debit card payments are processed as soon as the order is received using the debit or credit card details you provided at the time the order was placed by.

Any necessary refund will be processed through the debit card or credit card you used for payment at the time the order was placed in the event that the item or items you ordered are found to be insufficient to meet your order. You will be informed of any out of stock condition as soon as is reasonably possible.

Some of the products listed on our site may be incorrectly priced despite our best efforts. This condition occasionally occurs through human error or technical fault.

We are not obliged to provide you with any product at an incorrect or lower price. This condition applies even after we have sent you a notice as a confirmation that you placed the order at the incorrect or lower price.

This policy includes any obvious pricing error that could or should have been recognisable by you as an error at the time of ordering. Unmistakable and obvious pricing errors are the company’s decision and are the final decision in these infrequent, unavoidable, and unlikely events.

Payment is expected in full at the time the order is placed. Payment can be made through cash on delivery. Payment using credit cards or debit cards is considered to be immediately processed so that you can receive your merchandise in a timely manner.

Please note any deliveries to Scotland and Northern Ireland must be paid in full via credit and debit card on the day the order is placed. 

DELIVERY

All deliveries are made to the delivery address you provided when you placed an order with the company either on the website or in person.

We aim to deliver every sofa within 3-5 working days provided we have the item in stock. Otherwise all deliveries will occur within seven (7) to fourteen (14) days depending on the availability of the item ordered as designated in the order and the potential for placing a back order. All deliveries to Scotland and Northern Ireland will be 10 working days from the date of delivery provided the item is in stock.

Sofa Bargains determines the date of delivery in order to make delivery as efficient as possible for our customers.

The dimensions of all products are displayed clearly on each product page. You are required to assure that the items you have ordered for delivery will fit through any doors, stairs, landings, or passages in the residence or building you have designated for delivery of the purchased items on the order. If the delivery team arrive and the sofa/order does not fit into the door, you will be charged £70 to cover the cost of the delivery.

If you require dimensions that are not listed, please contact us and we will be happy to confirm the availability of any dimensions that are not named specifically on the website if you require dimensions that are not listed prior to delivery.

You are responsible for ensuring that the delivery team can gain easy access to the room that the furniture is going into. Make sure that the area where you want the furniture placed is clear on the day that is scheduled for the delivery of your purchase.

Neither our delivery team nor Sofa Bargains will be held responsible for any damage to either the customer’s property or belongings. You agree to this term at the time you place an order.

The customer that placed the order must sign for the delivery on the day the delivery occurs.

Sofa Bargains is aware of the variety of life circumstances that can prevent a delivery from occurring. We require a minimum of 72 hours notice prior to the agreed delivery date in the event that you are unable to take delivery of the products ordered on the previously agreed on delivery date. Failure to notify Sofa Bargains of a change in delivery date will result in the addition of a redelivery fee to the cost of the order.

 

PRODUCT SPECIFICATIONS

The right to change the specification of any products without prior notice in relation to future sales is retained by Sofa Bargains.

You, the customer, must check and verify the details of any product you ordered on our site concerning product design and specification changes because product design and specifications are frequently changed.

The products on display or advertised on the website may differ from the products supplied to you as a consequence of design or specification change from those on display or advertised on the site.

The products supplied to you will be of equivalent value, functionality, and appearance unless previously agreed to by the company at your request.

Sofa Bargains will notify you of any significant variations in product design or specifications that may occur after you have placed an order.

Small defects and blemishes in the materials used may sometimes be visible and are not considered to be damage but are considered to be natural imperfections in the manufacturing process. Your acceptance of an order and the delivery of that order imply agreement on your part to this condition.

Even though Sofa Bargains makes all reasonable and necessary effort to ensure that all products provided are measured as accurately as possible some slight variations in the measurements of all products may apply. You agree to this condition when you place an order.

Self-assembly may be required for some products. This condition is defined in the website in most instances.

Where stated, some images have been digitally created to illustrate the colour options available from the range. These colours will be affected by your monitor and by your printer and therefore may not be accurate to the finished product. Accurate colour swatches can be obtained from our stores.

 

 

COMPLAINTS

We strive to provide the best possible service to every customer. The company can be reached by telephone or e-mail if you have a specific complaint or comment. We will strive to deal with all reasonable complaints fairly, effectively, and confidentially. Any complaint or our response to that complaint does not affect your statutory or legal rights as a consumer.

 

AMENDING OR CANCELLING YOUR ORDER/REFUNDS

Should you wish to cancel and/or amend your order, you should contact Sofa Bargains immediately. This provision does not affect your other statutory rights as a consumer. Advice about your legal rights is available from your local Citizen Advice Bureau or trading standards office.

Should you cancel your Order in accordance with the provisions of clauses, once it has been delivered, we will collect such Goods. We will charge a collection cost of £100 for the Goods that we collect under the provisions of clause. The collection cost can increase depending on the nature of the Goods and where and when it is to be collected from. This cost will be notified to you in advance. In any event the Goods will remain your responsibility until we collect the Goods. 

You should also be aware of the following obligation: 

-       Any collection will be from the delivery address unless we agree otherwise, and we will agree with you a suitable day for collection.

-       If you are not available for collection yourself, you must notify us in advance of a nominated adult who will be present for the collection.

-       You must ensure that on the day of collection the access to the Goods is clear and free from obstruction.

-        If you or a nominated adult are not available or the access is not clear and free of obstruction then we will not collect the Goods.

-        Should windows or doors need to be removed to allow access, it is your responsibility to arrange this at your own cost and your own risk. We do not accept any responsibility for damage to your property during collection other than damage due to our negligence when our liability is limited to the repair of that damage with no element of betterment.

Please note that we do not accept any product returns which are due to an error on behalf of the customer such as not being aware of the dimensions which should be noted at the time of placing the delivery.

You have a statutory duty to take reasonable care of the Goods. If you breach this duty we have a right of action against you.If any original packaging has been left with you please return the Goods with the original packaging. If the original packaging is not available, then please ensure any items to be returned are packaged in a suitable and sufficient manner so as to ensure that there is no risk of damage in transit.

In the event that you do not comply with the above obligations, we may require payment from you of all costs reasonably incurred by us which may include but is not limited to wasted collection journeys or the cost of any Goods which you have damaged or lost or used.

 

 

Returning a product

 It is your responsibility to return the items to any location from which we do business in a good condition. However we recognise that many customers do not have the means to do this, and so will arrange collection during normal business hours if requested. In such circumstances a charge of 25% of the total price of the furniture will be made to cover the cost of collecting the items. We reserve the right to refuse to collect any sofas which have been damaged by you or have been used when the customer has claimed that they have been unused.

We will deduct a delivery and collection charge of £150 if the sofa has been used regardless of whether the product being returned is the fault of the customer or Sofa Bargains.

Any other refunds/products that have been made by the discretion of the manager will be deducted from the original price including original delivery charge when the product is picked up. The original price paid by the customer minus all of the above items will then be refunded in full. The manager reserves the right to issue a refund which could be higher than the sum total required to be refunded. Any product given as a part refund gesture which has been used cannot be returned and its value will be deducted from any final refund.

 We will also offer the customer a refund, minus an amount for the usage of the goods (called recision), in certain instances.

 

Taking care of the product before it is returned

It is the customer’s responsibility to take good care of the product. You are the owner of the furniture once it has been delivered and you are liable for any loss or damage. To minimise the risk of any such claim we ask that you return the goods in appropriate packaging such as to prevent damage in transit.

Until returned, the product must remain unused and in an ‘as new’ condition. Failure to take reasonable care may result in a claim against you.

 

Refunds

If you wish to return the Goods to us:

(a)               Because you have cancelled the Contract between us in terms of the Distance Selling Regulations, we will process the refund due to you as soon as possible but within 30 days of the day on which you gave us notice of cancellation. In such cases, we will refund the price of the product in full, and any applicable delivery charges, although for the avoidance of doubt we shall be entitled to offset and retain £150 collection charges in collecting the Goods.

(b)              For any other reason (for instance, because you consider the Goods are faulty), we will discuss the issue with yourselves and, if necessary examine the returned Goods. Should we agree the Goods are faulty we would reserve the right to discuss with you whether it would be more appropriate to repair the Goods in question. Should we agree with you that the Goods should be returned and you should obtain a refund, we will notify you of your refund via e-mail within a reasonable period of time. We will deduct £150 for collection of goods which the customer deems to be faulty and also deduct any other any other refunds/products that have been made by the discretion of the manager including the original delivery charge.

                    returned and its value will be deducted from any final refund.

 

                    . We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund.

c)                   If we have agreed to refund part money to you we will notify you of your refund via e-mail within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund.

We will usually refund any money received from you using the same method originally used by you to pay for your purchase or any other agreed payment method such as BACS,Cheque or Paypal.

The provisions of this agreement will not apply to any Goods which:

-       any Goods which cannot by their nature be disassembled once they have been partially assembled (such as flat pack coffee tables).
